Syarat & ketentuan

1. Agreement

These terms govern your use of imgcanva at imgcanva.com (the “service”). By using the service you accept them. If you do not agree, please do not use the service. If you use it on behalf of an organisation, you accept these terms for that organisation.

2. The service

imgcanva provides free image tools that run in your web browser. No account is needed. Accounts and paid plans are not offered at this time; if we introduce them, they will come with their own terms, which we will publish before they apply.

Some tools have limits, such as the number or size of files per task, which the tools display.

3. Your content

You keep all rights to the images and text you use with the service. Because the tools run on your device, we do not receive your images and claim no rights in them.

For the features that use our servers (HTML to image and Send to phone), you give us permission to handle the address or encrypted file only as far as needed to perform that feature for you, as described in the privacy policy.

You are responsible for your content and for having the right to use it. Keep your own copies of your originals: results are not saved for you, and nothing can be recovered once you close the page.

4. Acceptable use

You agree not to use the service to:

• process, create or share content that is illegal, or that infringes someone else's copyright, trademark, privacy or other rights;
• create sexual content involving minors, non-consensual intimate imagery, or images meant to harass, defame, deceive or impersonate a real person;
• remove watermarks or other notices from content you do not have the right to alter;
• capture web pages you are not allowed to access, or that forbid it in their terms, or point HTML to image at private or internal networks;
• overload, probe, scrape or disrupt the service, get around its limits or security, or reverse engineer it except where the law allows;
• use Send to phone to distribute malware or to host files for others.

We may block access to the server features, or to the service, for anyone who breaks these rules.

5. Third-party content and services

HTML to image shows pages from other websites, and the meme generator uses templates provided by Imgflip. We do not own or control that content; it remains the property of its owners and is subject to their terms. Donations are processed by Polar or bKash under their own terms.

6. AI tools

Tools such as remove background, upscale, blur face and the photo cleaner use machine-learning models that can make mistakes. For example, blur face may miss a face. Check every result before you rely on it, especially when privacy or accuracy matters.

7. Donations

Donations are voluntary gifts to support the service. They do not buy a product, a service, a feature or any special treatment. Donations are not refundable, except where the law or the payment provider's terms require a refund. Write to us if you donated by mistake.

8. Our rights

The service's software, design, text, logo and the imgcanva name belong to us or our licensors. These terms give you the right to use the service, not to copy, resell or rebrand it. Parts of the service are built with open-source software, which is used under its own licences.

9. Availability and changes

We may change, suspend or stop any part of the service at any time, for example to fix a problem or to retire a tool. The service is provided free, so we do not promise that it will always be available or free of errors.

10. No warranty

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of results and non-infringement, to the fullest extent the law allows.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, files, profits or business, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, which for a free service is zero.

Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or takes away rights you have as a consumer under the laws of your country.

12. Indemnity

If you use the service in breach of these terms or of someone else's rights, and a claim is brought against us as a result, you agree to cover the reasonable costs of that claim, to the extent the law allows.

13. Governing law and disputes

These terms are governed by the laws of Bangladesh. Any dispute will be handled by the courts of Dhaka, Bangladesh, unless the law of your country gives you the right to bring it in your local courts. Before going to court, please write to us; most problems can be solved quickly.

14. Changes to these terms

We may update these terms. The date at the top of this page shows the latest version. If a change is significant, we will say so on the site before it takes effect. Continuing to use the service after that means you accept the new terms.

15. General

If any part of these terms is found unenforceable, the rest stays in force. Not enforcing a part of these terms is not a waiver of it. These terms, with the privacy and cookies policies, are the whole agreement between you and us about the service.
